Gaming Gay Marriage

I have never quite understood the argument that gay sex is “unnatural.” Unless one believes that the only natural sex is that which reproduces the species, then how one chooses to express sexuality is as natural as differences in hair or skin color. If we admit that sex can be a means of expressing love, affection and physical pleasure rather than purely a reproductive act, then how one goes about doing that is as natural as variations in climate or on a theme. It does not matter if sexual preference is by “choice” or genetics or some combination thereof. Once the reproductive imperative is removed as the sole reason for having sex, then how one chooses to partake is almost limitless (I say “almost” because I adhere to convention that sex should be between consenting adults, or in the case of teenagers, between those of similar age, and that no coercion or exploitation can be involved).

I introduce the subject of gay marriage this way because I simply fail to understand why it is an issue. When I hear opponents argue against it I am reminded of the old Argentine saying about Catholic clergy opposed to divorce: if they do  not like divorce they should not marry. Or the more recent retort: if one does not like gay marriage then one should not marry a gay.

One thing is clear. The reproductive imperative does not apply to the legal recognition of straight marriages. Many heterosexual couples are childless by choice or circumstance. Some fulfill their parental instinct via adoption or with the help of surrogates, but others do not. In all cases they are legally free to marry.

Having thought about it a bit in light of recent arguments arising out a parliamentary bid to legalize gay marriage, it strikes me that the debate can be seen in simple game theoretic fashion.

Those opposed to gay marriage see the outcome if it is legalized in zero or negative sum terms. Awarding the right to marry to homosexuals will directly and negatively impact on heterosexual marriage. The belief is that awarding gays the right to marry comes at the immediate expense of heterosexual marriages, and that something will be directly lost or detracted from the latter if the former is permitted. Worst yet, the situation could become collectively negative sum if gays are allowed to marry: both gays and straights will suffer losses as a result (this is usually seen in the “children need hetero parents” argument, but extends to the costs of awarding full rights to married gay couples when it comes to family-oriented taxation, insurance and health benefits). The bottom line is that awarding equal marriage rights to gays (as a sexual minority) will impose costs or losses on the sexual majority, and therefore should not allowed under the lesser evil principle because collectively it is a lose-lose proposition.

Those in favor of gay marriage see the issue in even or positive sum terms. They see gay marriage as taking nothing from nor adding to hetero marriage, or in the most optimistic view, enhancing the value of marriage as an institution by extending the franchise to those of same-sex persuasion who wish to monogamously commit to each other in the eyes of the state (I will leave aside issues about non-monogomous unions and plural marriages in order to make the first-order point). In this view gay marriage should be encouraged as it deepens the familial bases of social stability and is therefore a greater good for society as a whole. It is a win-win solution.

Whatever other issues are put forth pro and con, it seems to me that this is the real crux of the issue. The rantings of bigots and extremists are not addressed here simply because they do not matter. I include in this God-botherers and other repressed and closeted people who act out of irrational psychological fear. Nor do I care to indulge the arguments of some extremists who think anything goes and there should be no prohibitions on sexual contact (say, the Man-Boy Love Association crowd). Here I am simply trying to distill the rational arguments in favor and against.

For me the issue is certainly even sum and probably positive sum. If we accept that one major source of social decay is the decline of the “traditional” family defined by heterosexual marriage, then it seems to me that one good response is to encourage the rise of “non-traditional” families as a complement. After all, “traditional” gender roles have been altered over the years (I would say for the better) without killing off the majority notion of marriage and family as the pillars of society, so I do not see how non-traditional marriage and families will be any more harmful to social stability than allowing women the vote or non-whites to have equal civil rights.

With regard to marriage specifically, there are already precedents for taking what was non-traditional or even taboo and making it commonplace. For example, marriages of mixed race or inter-faith couples, or those with intellectual or physical disabilities, once were viewed as suspect or dangerous (often on reproductive grounds), and in some cases legally proscribed. Today they are additional and welcome threads that rather than harm have added to the vibrancy of the matrimonial fabric of complex societies.

Anyway, this may be obvious to KP readers given their ideological dispositions. The point I am trying to make is that marriage is not a pie with a finite number of slices, where giving one slice to gays will mean that there is not enough left for straights. To the contrary, marriage should be seen as an expanding pie in with we can all share regardless of sexual preference because we commonly appreciate the order and stability it helps bring to our individual and collective lives. I reckon that is a very traditional way of thinking.

Competing electoral insurgencies, in Epsom and beyond

In this post I argue that ACT’s apparent willingness to undermine the MMP system that has kept them alive isn’t so much a death wish as a wish to be welcomed back into the National party as a faction, rather than a stand-alone party; to ensure influence from within rather than relying on influence without. I wrote most of this late at night and cobbled it together from several pieces I’ve had banging around a while with some more recent stuff appended, so you have my apologies if it’s a bit disjointed.

Fairfax political journalists Andrea Vance & John Hartevelt have a pretty sharp piece up, calling the ACT-National deal in Epsom a shameless power grab. I wrote about this topic a few days ago. Their analysis is pretty good, particularly the argument that National may have difficulty compartmentalising future ACT scandals away from National, having taken such direct responsibility for shielding ACT from the rigours of electoral democracy. They also make the point that I and many others have made about the dual exploitation-illustration of MMP’s flaws:

Double dealing and horse-trading are nothing new in the battle for political survival. Perversely, as we head towards a referendum, this naked and shameless power grab undermines the very system ACT relies on for survival. The ultimate irony is that Brash wants it replaced with the supplementary member system that would probably vanquish his party.

MMP, and particularly exploitation of the free-rider rule, is what has kept ACT alive since the 2005 election, when the party’s support dipped to its record low of 1.5%. Supplementary Member is the system that Brash personally supports, and although there is no official preference, this is widely regarded as being the system most preferable to most National party members and the wider ACT party also. SM, as proposed with a 90-30 electorate-list split, would indeed be worse for ACT as an independent party, requiring it to get something like 3% 2% of the party vote to gain a list seat, even if it continued to win an electorate. Leaving aside for a moment whether this is likely or not (ACT did, in its heyday, poll well), that’s a considerable disadvantage because National would no longer have such a good reason to throw ACT an electorate seat lifeline. National’s doing so is apparently only tolerated by Epsom voters on the basis of the overall positive-sum value proposition made by John Banks: “vote for me, and I’ll bring five MPs with me on current polling”. You’d be a fool to turn that offer down. Reduce the premium to one MP and it suddenly becomes rather less appealing.

So on paper ACT supporting a non-MMP system looks like a turkey voting for an early Christmas. But I think the game goes deeper than that. ACT has in recent years abandoned its claims to being a classical liberal party, and is now basically a more hardline version of National’s dry petit-authoritarian conservatism, with a few casual nods to “freedom”, such as in alcohol policy. In recent months it has been colonised by the former right of the National party (Brash and Banks, most notably; also “National in Gumboots” Federated Farmers former president Don Nicolson). Both the former were until very recently long-standing National members whose tribal loyalty undoubtedly lies with that party. They see it as having strayed from its roots, and while they undoubtedly appreciate its newfound popularity with voters, they have repeatedly expressed strong concerns that the party has lost its way, and an intention to bring it back around by putting “reinforcing steel” into its governments (in the words of John Banks). Both, I think, would join National again in a heartbeat if National would have them, and would permit them any influence. An electoral system switch to SM makes that a more viable possibility, and brazenly exploiting both the two major flaws to which most people object in MMP — the threshold free-rider rule and the “back door” rule that lets a rejected candidate such as Don Brash back in on the list — sets up a reasonably strong case against MMP.

Supplementary Member has the worst features of both FPP and MMP. It has high noise (the variance between the makeup of the electorate’s votes and the makeup of the resultant parliament), delivers huge incumbency advantages to parties that hold many electorate seats (because there are more of them), severely marginalises smaller parties by reducing proportionality, and despite all this does not meaningfully solve the symbolic split between “legitimate” electorate-based MPs and those who ‘only’ come in on the list, nor the threshold, “back door” or “horse-trading” objections that most critics name as MMP’s worst flaws. (BK Drinkwater modeled FPP, MMP and SM against each other using election data since 1996, although bear in mind that for SM, these figures assume a 70-50 electorate-list split, which is considerably more proportionate than the 90-30 proposed).

National holds many more electorate seats than Labour, and has nearly always done so, even when its popular vote has been lower because its base of support is less concentrated in inner-city and suburban electorates. Any system of reapportioning electorates on the basis of population will continue to entrench this advantage. Under MMP, it is not a very significant advantage; under FPP and SM, however, it is. ACT’s electoral support, both in electorates and nationally, is very weak, largely because their policies are purposefully divisive, with the intent of galvanising a small proportion of “right thinking” voters against the mainstream. National’s strategy since 2006 has been to occupy the centre-ground and cannibalise Labour’s votes in a zero-sum fashion. This has been a strategy of necessity — the 2005 election demonstrated pretty categorically that divisive politics, no matter how much money you could throw at it, no matter how favourable the cultural terrain, or how good the propaganda, was not a winner for National in an MMP environment. The incumbency and electorate edvantage delivered by SM, however, would cushion them against voter discontent and permit a more hardline approach: one that included ACT as a faction within the National party, as it previously was. So under SM, ACT doesn’t need National to throw it a bone, and National doesn’t need to rort the system to extract electoral advantage: National under SM will enjoy sufficient advantage to simply absorb ACT and its policy programme, and its governments will be emboldened to enact divisive or unpopular aspects of that programme without the same fear of electoral blowback that now constrains it. ACT’s strategy is therefore an insurgency against National; one that may be permitted by National, contingent upon the adoption of a more beneficial electoral system.

A further comment on Labour’s response in Epsom is also warranted. Arthur (in comments to my post linked above) suggested that the best way to nix ACT in the 2011 election is for all Labour and Green voters to cast electorate votes for the National candidate, Paul Goldsmith, in the hope that this will send a signal to National voters who are unhappy with the horse-trading between ACT and National that it might be worth defecting. This is, in principle, a strong strategy, and it has been picked up by some Green supporters as well. But I think it’s the wrong strategy in this case, for five reasons. First, it’s a complex and counterintuitive strategy, and it’s extremely hard to get so many people (on both sides) to act against their own instincts like that. Second, the value proposition made by ACT (six for the price of one) is simply too good for a meaningful number of National voters to pass up. Third, it would require Labour to publicly endorse a National candidate, which would permit John Key to proclaim that “even the opposition supports the National party”. Fourth, the electorate demographics for Epsom don’t stack up: this electorate bleeds blue and even if a fair proportion of disgruntled Nat voters defected, I don’t think there would be enough Green and Labour voters to prevail. Fifth, it would require Labour to buy into the electoral-system rorting, making them no better than the National and ACT parties.

Labour looks like it will mount an ‘economic dry’ insurgency by standing David Parker in Epsom. This is a better strategy because it is vulnerable only to the objections two and four above (the positive-sum value proposition, and demographics). These will probably still mean that it is unsuccessful in terms of winning Labour the electorate and denying ACT parliamentary representation, but it also has the advantages of fighting the national and ACT parties on their own turf — economic responsibility — and in demonstrating that even when they’re down, Labour fights fair and respects the integrity of the electoral system. Most crucially, however, whatever strategy is adopted by the left in Epsom must be coordinated. The two proposed strategies (vote Goldsmith and vote Parker) are contradictory: one must be abandoned, and soon, in favour of the other. Because if the Green faction goes into Epsom with one strategy and the Labour faction goes in with another, there’s only one winner: ACT.

S59 referendum: a game theory approach

How* to vote: Yes, [null] or !#gh$u%WfG?

What’s a body to do, who thinks the S59 referendum question is absurd and yet supports the rights of children to be free from violence, even that perpetrated by their well-meaning parents?

Russell Brown asks the question, and elaborates on the options, but doesn’t provide an answer. Essentially, the question is about principle against pragmatism. This approach is pretty elementary (game theory isn’t a speciality) but it does enough to demonstrate my views on the matter. (It looks to me like a weird sort of Stag Hunt with a third quarry thrown in). There are also a few assumptions and assessments as to how the results will play, which I’m happy to argue. I apologise if it all seems a bit bleedin’ obvious.

mehStarting with the worst response, the third quarry or null vote. An argument of principle, advocated by Denis Welch, it holds that people should treat the s59 referendum with utter contempt and dispose of their share of the $9m expense in the circular file. This is possibly best characterised as the Ostrich Strategy, viz. “ignore it and it’ll go away”. Unfortunately, no cause which attracts signatures from the 10% of the electorate required to trigger a CIR will ever just go away on its own. Given that there are a hard core of people who are strongly motivated to vote “no” in this referendum, the adoption of this strategy will send the (incorrect) message that the bulk of the electorate doesn’t care either way, ceding the field to the “no” voters (hereafter “anti-anti-smacking” or “AAS”). We can call this “Lose For Sure”, because no matter what happens, the strategy can’t win.

chadThe main argument of principle, made most forcefully in the PAS thread by Craig Ranapia and Tom Semmens, is that the question is so badly worded that reading meaning into it and voting on the basis of that interpretation accords the question too much respect, and devalues the CIR system which should insist on properly-formed questions. This argument holds that one should respond to a meaningless question with a meaningless answer by invalidating the ballot and submitting it anyway, which I have characterised above as “!#gh$u%WfG”; in other words, leaving the chad hanging or writing something to the effect of “This question is meaningless” on the ballot and returning it. This has some history in previous referenda, and in principle if enough informal ballots were returned, could serve to discredit the question and the questioning lobby group. Which is what we want. We can call this “Win Big”, because if enough people take this approach, the anti-anti-smackers will be roundly shamed in a more thorough manner than simply losing the referendum. On the other hand, if not enough people do this and the votes are split between “yes” and “informal” the AASers will claim victory. We’ll call this “Lose”.

yesThe argument in pragmatic terms is most eloquently put by Judy Callingham: “I’m going to vote “yes” – as I see it if the bastards don’t lose we’ll never hear the end of them”. This illuminates a key aspect of the matter: the AAS lobby doesn’t have to win big, they just have to not lose in order to demonstrate that they represent the “average kiwi”. This means the primary goal of those opposed to the question or what it represents should be to win, regardless of the magnitude of the victory. Put like that it seems obvious, doesn’t it? This position is most strongly put by The Yes Vote, whose banners are currently up all around the progressive NZ blogosphere. Essentially, if enough people interpret the question in the way in which the AAS want people to interpret it and vote “yes” anyway, they will lose, and the outcome will be positive, viz. parents not being allowed to claim correction as a defence for beating their children. We’ll call this “Win”. Those so voting will have favoured the AAS with a formal answer to their ballot, thus granting them some sort of legitimacy, and if insufficient people vote this way such that it boosts turnout and the AAS still win, they will rightly be able to claim that they have a public mandate for their policy of allowing parents to assault children with legal protection. We’ll call this “Lose Big”.

So, how do things stack up? I’ve established five notional outcomes, as follows:

  • Lose For Sure: %No > %Yes > %Informal (low turnout). This would be caused by people who object to the question refusing to vote.
  • Win Big: %Informal > (%Yes or %No) > (%Yes or %No). This would be caused by enough people voting informally to outnumber those who vote any other way, rendering the referendum a public farce. This requires a great deal of work to convince those who would instinctively vote “yes” despite disagreeing with the question, out of native respect for the democratic process or for other reasons.
  • Lose: %No > (%Yes or % Informal) > (%Yes or % Informal). This would be caused by those objecting to the question being split between “yes” and “informal” such that “no” snuck through the gap, allowing the AAS to claim a plurality and thus victory. There would remain some defence in that the cumulative “yes” and “informal” votes might add up to a majority, but I don’t think this would be worth much.
  • Win: %Yes > (%No or %Informal) > (%No or %Informal). This would be caused by enough people voting “yes” to demonstrate that the AAS does not represent the “average Kiwi” as they claim. It seems likely that those who consider the question an affront to the democratic process and are inclined to vote informally or not vote at all would need to be convinced to vote “yes” instead.
  • Lose Big: %No > %Yes > %Informal (high turnout). This would be caused by enough people voting “yes” to demonstrate that those opposed to the AAS were taking them seriously, but were outnumbered by the AAS itself, thereby justifying the claim that they represent the “average kiwi” with the assertion having been properly tested. If some (but not enough) people are convinced that voting “yes” is the right idea, this will be the result. Thus there is danger in an incomplete adoption of the strategy.

So how should one vote? Well, it obviously rests on what other voters will do. Clearly the best outcome in the case of a split requires collusion – members of one group (either the “informal” voters or the “yes” voters) changing their vote. It looks to me like this:

  • Fail to vote: Many people will do this, but it won’t have any positive effect for anyone other than the AAS. P(Lose For Sure) > *
  • Vote informally: Some people will do this, but probably not enough to Win Big, and if the result isn’t Win Big, it’s more likely to be Lose. This rests on your judgement of whether the number of informal voters will be greater than the number of “no” voters. I don’t think they will. Thus in my assessment P(Lose) > P(Win Big) > *
  • Vote yes: If enough people do this, it will result in Win. If nearly enough people do this it will result in Lose Big. I think the natural tendency of voters is to vote according to what they think something means, rather than what it actually means in cold hard terms. In addition, I think voters are generally reluctant to vote informally out of respect for the institutions of democracy. In addition, I think The Yes Vote has been running a fairly good campaign – they’ve had a few mentions in the mainstream media, and their message is clear and forthright. Therefore in my assessment P(Win) > P(Lose Big) > *

So, essentially, my argument based on this is “vote yes, support campaigns to convince others to vote yes, and all those of you who are considering not voting or voting informally in protest – don’t, just vote yes, because the main danger of losing is in splitting the vote. And hope like hell the yes vote doesn’t fall short, because trying and failing will mean a worse loss than just plain old failing.”
